These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Kash India (Proprietorship), doing business as Nutrify Me AI (“we,” “us,” “our,” or “Nutrify Me AI”), governing your access to and use of the website at www.nutrifyme.ai and the Nutrify Me AI mobile application (available on iOS and Android), and all related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

THIS SERVICE IS NOT A MEDICAL DEVICE, MEDICAL SERVICE, OR HEALTHCARE PROVIDER. Nutrify Me AI is a wellness and nutrition information tool powered by artificial intelligence. Before reading the full Terms below, please understand the following critical limitations:

NOT MEDICAL ADVICE: Nutrify Me AI does not provide medical advice, medical diagnosis, or medical treatment. All content generated by the Service — including meal plans, dietary suggestions, nutritional estimates, and conversational responses — is for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

ALWAYS CONSULT YOUR DOCTOR: You should always consult a qualified healthcare provider (physician, registered dietitian, or licensed nutritionist) before making any changes to your diet, especially if you have any medical condition, are taking any medication, are pregnant or breastfeeding, have a history of eating disorders, or have any other health concern.

AI IS NOT PERFECT: Our AI systems may produce inaccurate, incomplete, or inappropriate nutritional estimates, meal suggestions, or dietary recommendations. AI-generated content has NOT been reviewed or verified by licensed healthcare professionals, registered dietitians, or certified nutritionists.

LIFE-THREATENING RISKS: If you have severe food allergies (e.g., anaphylactic reactions to nuts, shellfish, or other allergens), you must NOT rely solely on this Service to identify allergens in your food. AI food recognition is not 100% accurate and may fail to identify allergens that could cause serious injury or death.

NOT FOR EMERGENCIES: If you are experiencing a medical emergency, call your local emergency services immediately. Do not use this Service for emergency health decisions.


1. Description of the Service

Nutrify Me AI is an AI-powered nutrition and meal planning platform that enables you to:

  • Create a health profile with your body metrics, dietary preferences, goals, and (optionally) medical conditions, medications, allergies, lab values, and family history.
  • Receive AI-generated personalized meal plans tailored to your health profile.
  • Analyze food photographs using AI image recognition to estimate nutritional content.
  • Interact with an AI-powered conversational nutrition assistant for dietary guidance and nutrition questions.
  • Track your daily nutritional intake, macronutrient breakdown, and progress toward your dietary goals.
  • Upload blood/lab report images for AI extraction of health values to further personalize your recommendations.

Nutrify Me AI is a wellness and information tool, not a medical service. We provide AI-generated dietary suggestions and nutritional information only. We are not a healthcare provider, medical device, clinical decision-support system, telemedicine platform, or electronic health record system.

We reserve the right to add, modify, suspend, or remove any feature of the Service at any time, at our sole discretion, with or without notice. The description above is illustrative and does not constitute a guarantee that any specific feature will remain available.


2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher).
  • Have the legal capacity to enter into a binding agreement.
  • Not have been advised by a healthcare provider to avoid using AI-based dietary tools or calorie-tracking applications (including due to a history of eating disorders — see Section 8.5).
  • Not be prohibited from using the Service under any applicable law.

We reserve the right to refuse service, terminate accounts, or cancel subscriptions at our sole discretion if we reasonably believe that any of these conditions are not met, without any obligation to provide reasons or refunds.

Parental Notice: Nutrify Me AI is not designed for, marketed to, or intended for use by anyone under 18. We do not knowingly collect personal information or health data from minors. If we discover that a minor has created an account, we will terminate it and delete all associated data within 48 hours.


3. Account Registration and Security
3.1 Account Creation

To access the Service, you must create an account by providing accurate, complete, and current information, including your name and email address. You may also sign in using third-party authentication (Google or Apple Sign-In). If you use Google or Apple Sign-In, your use of that authentication service is subject to the respective provider's terms of service and privacy policy ( Google Terms of Service or Apple Media Services Terms and Conditions). We are not responsible for the availability, security, or policies of third-party authentication providers. If a third-party authentication provider experiences an outage, changes its policies, or terminates your account, we are not liable for any resulting inability to access the Service. You agree to update your account information promptly if it changes.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, whether or not authorized by you. Given the sensitive health data stored in your account, you are strongly encouraged to use a strong, unique password and enable any additional security features available.

You agree to:

  • Choose a strong, unique password and not share it with others.
  • Notify us immediately at help@nutrifyme.ai if you suspect unauthorized access to your account.
  • Not transfer, sell, or assign your account to another person without our prior written consent.

We are not liable for any loss or damage arising from unauthorized access to your account, including unauthorized access to your health data, regardless of the cause.

3.3 Health Data Accuracy

You are solely responsible for the accuracy of the health information you provide to the Service. This includes your body metrics, medical conditions, medications, allergies, and any lab values. Inaccurate health data may result in inappropriate meal plans or dietary suggestions. If you input incorrect medical conditions, allergies, or medications, the AI's recommendations may be unsuitable or potentially harmful. Nutrify Me AI is not liable for any adverse outcomes resulting from inaccurate health data you provide.



4. User Responsibilities
4.1 Accurate Health Information

You are solely responsible for providing accurate, complete, and up-to-date health information. If your medical conditions, medications, allergies, or other health circumstances change, it is your responsibility to update your health profile in the Service. We are not liable for adverse outcomes resulting from outdated or inaccurate health information in your profile.

4.2 Professional Medical Consultation

You must consult a qualified healthcare provider before acting on any dietary suggestion, meal plan, or nutritional information provided by the Service, especially if:

  • You have been diagnosed with any medical condition (diabetes, hypertension, kidney disease, cardiovascular disease, PCOS, thyroid disorders, or any other condition).
  • You are currently taking any medication (dietary changes can interact with medications).
  • You are pregnant or breastfeeding.
  • You have a history of eating disorders or disordered eating behaviors.
  • You have severe food allergies (particularly allergies that can cause anaphylaxis).
  • You are recovering from surgery or illness.
  • You have been placed on a medically prescribed diet by your physician or dietitian.

The Service does not replace professional medical advice, and you assume all risk if you act on AI-generated suggestions without consulting your healthcare provider.

4.2A Pregnancy and Breastfeeding — Enhanced Warning

CRITICAL WARNING FOR PREGNANT OR BREASTFEEDING USERS: Nutritional requirements during pregnancy and breastfeeding are highly specific, medically sensitive, and change throughout each trimester and postpartum period. Inadequate or inappropriate nutrition during pregnancy can pose serious risks to both maternal and fetal health, including but not limited to gestational diabetes, preeclampsia, neural tube defects, fetal growth restriction, and preterm birth. Nutrify Me AI's AI models are NOT trained as prenatal or postnatal nutrition specialists. The AI may fail to account for pregnancy-specific nutritional requirements (e.g., increased folate, iron, and DHA needs), foods to avoid during pregnancy (e.g., certain fish, unpasteurized dairy, deli meats), or breastfeeding-specific dietary considerations. If you are pregnant, planning to become pregnant, or breastfeeding, you MUST consult your obstetrician, midwife, or a registered dietitian specializing in prenatal/postnatal nutrition before following any meal plan or dietary suggestion from the Service. We are not liable for any adverse maternal, fetal, or infant health outcome arising from your use of the Service during pregnancy or breastfeeding.

4.3 Food Allergy Responsibility
⚠️ Critical Warning

While our AI attempts to consider your declared allergies when generating meal plans, AI food recognition and meal planning are NOT 100% reliable for allergen detection. Specifically:

  • AI analysis of food photographs may fail to identify all ingredients, including hidden allergens (e.g., cross-contamination, unlabeled ingredients, trace amounts).
  • AI-generated meal plans may occasionally include ingredients that conflict with your declared allergies due to AI model limitations.
  • We do not guarantee that any meal plan, food identification, or recipe suggestion is free from allergens you have declared.

If you have severe or life-threatening food allergies, you must independently verify all food items, ingredients, and recipes suggested by the Service. You must NOT rely solely on the Service for allergen avoidance. Failure to independently verify allergens could result in serious injury or death, for which Nutrify Me AI assumes no liability.

4.4 Medication Interaction Awareness

If you input medications into the Service, the AI may attempt to consider known food-drug interactions when generating recommendations. However:

  • The AI is NOT a pharmacist or physician. It cannot reliably detect all food-drug interactions.
  • The AI's knowledge of drug interactions may be incomplete, outdated, or incorrect.
  • We do not guarantee that the AI will identify or warn you about every relevant food-drug interaction.
  • You must consult your physician or pharmacist about dietary considerations related to your medications. The Service is not a substitute for professional pharmacological advice.
4.5 Eating Disorder Awareness

Nutrify Me AI involves tracking nutritional intake, calories, and macronutrients. If you have a current or past history of eating disorders (including anorexia nervosa, bulimia nervosa, binge eating disorder, orthorexia, or other disordered eating patterns), calorie and nutrition tracking tools may trigger or exacerbate your condition.

  • You acknowledge that you use the Service at your own risk in this regard.
  • If you find that using the Service is causing obsessive behavior around food, anxiety about eating, unhealthy restriction, or any other concerning patterns, please stop using the Service immediately and consult a healthcare professional.
  • We are not liable for any harm resulting from the use of the Service by individuals with current or past eating disorders.
4.6 Lab Report Upload Responsibility

When you upload a blood/lab report image:

  • You represent that the lab report belongs to you and was obtained through legitimate medical testing.
  • You understand that AI extraction of values from lab report images may be inaccurate due to image quality, formatting variations, handwritten notes, or AI limitations.
  • You must verify all extracted lab values against your original report before relying on the AI's interpretations or recommendations based on those values.
  • The AI's interpretation of lab values is NOT a medical diagnosis. The AI cannot diagnose medical conditions from lab values. Only a qualified healthcare provider can interpret lab results in the context of your complete medical history.
  • We are not liable for inaccurate extraction of lab values or for any recommendations based on incorrectly extracted values.

5. Acceptable Use Policy
5.1 Permitted Use

You may use the Service only for your own personal, non-commercial health and wellness purposes: receiving AI-generated meal plans, tracking your nutrition, and accessing dietary information.

5.2 Prohibited Conduct

You agree not to use the Service to:

  • Upload health data belonging to another person without their explicit consent.
  • Upload fraudulent, fabricated, or misleading health data.
  • Use the Service as a substitute for professional medical advice, diagnosis, or treatment.
  • Attempt to use the Service for clinical, diagnostic, or medical decision-making purposes.
  • Upload malware, viruses, or any code designed to disrupt the Service.
  • Circumvent, disable, or interfere with any security, rate-limiting, or access-control features of the Service.
  • Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the Service, including our AI models, algorithms, or recommendation engine.
  • Scrape, harvest, or collect data from the Service for purposes not authorized by these Terms.
  • Resell, sublicense, or redistribute access to the Service without our prior written consent.
  • Use the Service to generate content for competing products or to train competing AI models.
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service.
  • Use the Service for any illegal purpose or in furtherance of any illegal activity.
5.3 Enforcement

We reserve the right to investigate suspected violations and to take any action we deem appropriate, at our sole discretion and without prior notice, including: issuing warnings, suspending features, suspending or terminating your account, deleting data, and reporting violations to law enforcement or affected third parties. We are not required to provide advance notice, a hearing, or an opportunity to cure before taking enforcement action. We will not be liable for any losses or damages you incur as a result of enforcement actions taken in good faith.


6. User Content and Health Data
6.1 Your Ownership

You retain ownership of all health data, meal logs, and personal information you input into the Service (“User Content”).

6.2 License Granted to Nutrify Me AI

By inputting data into the Service, you grant Nutrify Me AI a non-exclusive, worldwide, royalty-free license to use, reproduce, process, transmit, and store your User Content solely for the purposes of: (a) operating and providing the Service, (b) generating personalized meal plans and recommendations, (c) powering AI features, and (d) maintaining backups and logs as described in our Privacy Policy.

You also grant Nutrify Me AI a perpetual, irrevocable, worldwide, royalty-free license to use aggregated, anonymized, and de-identified data derived from your use of the Service (from which no individual can be identified and from which no individual health information can be reconstructed) for any lawful business purpose, including analytics, benchmarking, product development, and marketing. We will never use your individual, identifiable health data for these secondary purposes — only truly anonymized aggregate data.

6.3 Health Data Deletion

You may delete any or all of your health data at any time through the app settings. Upon deletion:

  • The deleted data will be permanently removed from our active systems within 15 days.
  • The Service will continue to function using only the data you have retained, but recommendations may be less personalized.
  • Deletion of health data does not constitute cancellation of your subscription.
6.4 No Backup Obligation

Nutrify Me AI is not a medical records storage or backup service. While we store your data as described in our Privacy Policy, we do not guarantee long-term preservation of your health data, meal logs, or AI chat history beyond the retention periods stated. You are responsible for maintaining your own records of your health information.


7. AI-Powered Features — Disclaimers and Limitations
7.1 AI Meal Plan Generation

Nutrify Me AI generates personalized meal plans using AI language models (powered by OpenAI and Google Gemini). Important disclaimers:

  • Meal plans are AI-generated suggestions, not medical prescriptions. They have NOT been reviewed or approved by a licensed dietitian, registered nutritionist, or healthcare provider.
  • Nutritional values are estimates. All calorie counts, macronutrient breakdowns, and micronutrient estimates are AI-calculated approximations. They are not based on a verified nutritional database and may differ significantly from actual nutritional content.
  • Portion sizes are approximate. AI-estimated portion sizes may not match your actual serving sizes.
  • The AI may not account for all your health factors. Even if you provide medical conditions and medications, the AI may not correctly interpret their dietary implications.
  • Meal plans may include unsuitable items. Despite your declared allergies, preferences, and conditions, AI-generated plans may occasionally include items that are inappropriate for your health situation. Always review meal plans before following them.
7.2 Food Photo Analysis

When you photograph food for nutritional analysis:

  • Food identification is based on AI visual recognition and is NOT 100% accurate. The AI may misidentify foods, miss ingredients, underestimate or overestimate portions, or fail to recognize items entirely.
  • Nutritional estimates from photos are rough approximations. They should not be treated as precise measurements.
  • The AI cannot detect allergens from photos. A food photograph cannot reliably reveal all ingredients, preparation methods, or cross-contamination risks.
  • The AI may not recognize regional, cultural, or unfamiliar foods. Accuracy may vary significantly based on cuisine type, presentation, and food familiarity.
7.3 AI Nutrition Chat Assistant

The conversational AI nutrition assistant (powered by Anthropic Claude) provides informational responses to your dietary and nutrition questions. Important disclaimers:

  • The AI assistant is not a healthcare provider. It cannot provide medical advice, diagnose conditions, or prescribe treatments.
  • Responses may be inaccurate, incomplete, or outdated. The AI generates responses based on patterns in training data and may produce information that is incorrect or not applicable to your situation.
  • The AI may occasionally provide contradictory information. Different responses in the same conversation may not be fully consistent.
  • The AI cannot replace a consultation with a registered dietitian or physician. For specific dietary advice related to medical conditions, always consult a qualified professional.
  • The AI defers to healthcare providers. The AI is designed to recommend that you consult your doctor for medical decisions. However, this safeguard is not foolproof, and the AI may occasionally fail to include appropriate medical disclaimers.
7.4 Lab Report Analysis

When you upload a lab report for AI value extraction:

  • AI extraction of lab values may be inaccurate. OCR and image recognition technology may misread numbers, units, test names, or reference ranges from your lab report. Accuracy depends on image quality, report format, and legibility.
  • The AI does NOT diagnose medical conditions. Even if the AI identifies that a lab value is outside a normal range, this is NOT a medical diagnosis. Only a qualified healthcare provider can interpret lab results in the context of your medical history.
  • Recommendations based on lab values are general dietary suggestions, not treatment plans. For example, if the AI notes low iron levels and suggests iron-rich foods, this is general wellness information — not treatment for iron deficiency anemia, which requires medical evaluation.
  • You must verify all extracted values. Always compare AI-extracted values with your original lab report and consult your healthcare provider for interpretation.
7.5 No Guarantee of Health Outcomes

Nutrify Me AI does NOT guarantee any health outcome, weight change, improvement in lab values, management of any medical condition, or any other health result. Individual results vary based on countless factors including genetics, overall lifestyle, adherence to recommendations, accuracy of self-reported data, accuracy of AI outputs, concurrent medical treatments, and factors beyond our knowledge or control. You use the Service entirely at your own risk.

7.6 AI Hallucination and Confabulation Risk

All AI models used by the Service (including OpenAI GPT, Google Gemini, and Anthropic Claude) are subject to a well-documented phenomenon known as “hallucination” or “confabulation,” whereby the AI generates outputs that appear factual and confident but are partially or entirely fabricated. In the context of Nutrify Me AI, this means:

  • The AI may invent nutritional values, calorie counts, or macronutrient data that have no basis in any food database or scientific source.
  • The AI may fabricate food-drug interactions or medical claims that are incorrect, misleading, or dangerous.
  • The AI may present made-up dietary guidelines as authoritative recommendations. AI responses may cite non-existent studies, reference fabricated medical guidelines, or present fictional nutrition science with confidence.
  • The AI may misidentify foods in photographs and confidently provide nutritional data for the wrong food.
  • The AI may misread lab report values and present incorrect numbers as extracted results.

Nutrify Me AI has no reliable mechanism to detect or prevent all AI hallucinations. While we implement prompt engineering and safety guardrails to reduce the frequency of hallucinations, these measures are imperfect and cannot guarantee accuracy. You must independently verify all AI-generated information — particularly any information related to allergens, medications, medical conditions, or lab values — before acting on it. Failure to do so could result in serious harm.

7.7 AI Technology Changes

We reserve the right to change the underlying AI providers, models, and technologies used in the Service at any time, without notice. This includes changing the providers powering meal plans, food analysis, or the chat assistant. Such changes do not constitute a material change to the Service for purposes of these Terms, provided the core functionality of the Service is maintained.

7.8 Assumption of Risk
BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH:
  • Acting on AI-generated meal plans, dietary suggestions, nutritional estimates, food identifications, lab value extractions, and conversational responses.
  • Using the Service as a dietary guidance tool when you have any medical condition, food allergy, medication, pregnancy, breastfeeding status, history of eating disorders, or other health circumstance.
  • The inherent limitations and inaccuracies of artificial intelligence technology, including the risk of hallucination, confabulation, and errors described in this Section 8.
  • Making dietary decisions based on AI-estimated nutritional data that has not been verified by a licensed professional or sourced from a certified nutritional database.
  • Uploading lab reports and relying on AI-extracted values without independent verification by your healthcare provider.
  • Using any Beta Features (see Section 22) for health-related decisions.

YOU AGREE THAT YOU ARE VOLUNTARILY CHOOSING TO USE THE SERVICE WITH FULL KNOWLEDGE OF THESE RISKS, THAT NUTRIFY ME AI HAS CLEARLY DISCLOSED THESE RISKS TO YOU, AND THAT YOU ACCEPT PERSONAL RESPONSIBILITY FOR ALL DIETARY AND HEALTH DECISIONS YOU MAKE WHILE USING OR BASED ON THE SERVICE. THIS ASSUMPTION OF RISK IS INDEPENDENT OF AND IN ADDITION TO THE LIMITATIONS OF LIABILITY IN SECTION 14.


8. Third-Party Platform Terms
8.1 Apple App Store and Google Play Store

If you download or use the Nutrify Me AI mobile application:

  • Your use is subject to the applicable app store's terms of service (Apple Media Services Terms and Conditions or Google Play Terms of Service).
  • We, not Apple or Google, are solely responsible for the Service and its content.
  • Apple and Google have no obligation to provide maintenance, support, or warranty for the Service.
  • Apple and Google are not responsible for addressing any claims relating to the Service, including product liability claims, claims that the Service fails to meet legal or regulatory requirements, and consumer protection claims.
  • Apple and Google are third-party beneficiaries of these Terms (with respect to the mobile app) and have the right to enforce these Terms against you.
8.2 Changes to Third-Party Services

Third-party platforms (including OpenAI, Google Gemini, Anthropic Claude, Apple, Google, and Firebase)may change, restrict, deprecate, or discontinue their APIs, services, or pricing at any time. Such changes may temporarily or permanently affect features in Nutrify Me AI. We will make reasonable efforts to adapt to changes, but we do not guarantee uninterrupted availability of any particular feature or integration.


9. Service Availability and Uptime
9.1 Availability

Nutrify Me AI aims to maintain reasonable availability of the Service, but we do not guarantee any specific uptime percentage. The Service may be unavailable due to:

  • Scheduled maintenance (we will provide advance notice whenever reasonably possible).
  • Unscheduled maintenance or emergency fixes.
  • Downtime caused by third-party services (AI providers, cloud infrastructure, payment processors, app stores) being unavailable.
  • Force majeure events (see Section 18).
  • Issues caused by your internet connection, device, operating system, or any factor outside our reasonable control.
9.2 No Critical Reliance

You must NOT rely on the Service for time-sensitive or critical health decisions. The Service may be unavailable when you need it. Always maintain access to your healthcare provider and have alternative sources of dietary guidance. The Service is a supplementary wellness tool, not a primary healthcare resource.


10. Intellectual Property
10.1 Our Intellectual Property

The Service, including its design, user interface, code, algorithms, AI integration, recommendation engine, graphics, logos, trademarks, trade names (“Nutrify Me AI,” the Nutrify Me AI logo), and all related documentation, is the exclusive property of Kash India and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended personal, non-commercial purpose in accordance with these Terms.

10.2 Restrictions

You may not:

  • Copy, modify, distribute, sell, lease, or create derivative works based on any part of the Service.
  • Reproduce or publicly display any of our trademarks, logos, or branding without our prior written consent.
  • Use the name “Nutrify Me AI” or any confusingly similar name to promote competing products or services.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the Service.
  • Attempt to extract, replicate, or reverse-engineer our AI models, recommendation algorithms, or proprietary systems.
  • Use the Service's output to train, fine-tune, or develop competing AI systems.
  • Reproduce, distribute, or commercially exploit AI-generated meal plans, nutritional analyses, or other Service outputs beyond your personal use.
10.3 Feedback

If you provide us with suggestions, ideas, feature requests, bug reports, or other feedback about the Service (“Feedback”), you grant us an unrestricted, irrevocable, perpetual, worldwide, royalty-free, sublicensable license to use, modify, incorporate, and commercialize such Feedback in any way without any obligation, compensation, or attribution to you.


11. Privacy and Data Protection

Your privacy is critically important given the health data involved. Our collection, use, storage, and protection of your personal data and health data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that you have read and understood our Privacy Policy and explicitly consent to the collection and processing of your health data as described therein.


12. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, Nutrify Me AI does not warrant that:

  • The Service will be uninterrupted, error-free, or free from viruses or other harmful components.
  • AI-generated meal plans, dietary suggestions, or nutritional information will be accurate, complete, appropriate, safe, or suitable for your health situation.
  • Nutritional estimates (whether from photos, manual logging, or AI analysis) will be accurate or precise.
  • The AI will correctly identify all food items, ingredients, allergens, or portion sizes from photographs.
  • The AI will correctly extract all values from uploaded lab reports.
  • The AI nutrition assistant will provide accurate, current, or complete information in response to your questions.
  • The AI will correctly consider your medical conditions, medications, allergies, or other health factors when generating recommendations.
  • The AI will identify all relevant food-drug interactions.
  • The Service will produce any specific health outcome, including weight loss, weight gain, improved lab values, or management of any medical condition.
  • Third-party AI providers (OpenAI, Google Gemini, Anthropic Claude) will remain available, functional, or unchanged.
  • The Service will be compatible with all devices, operating systems, or browsers.
  • AI outputs will be free from hallucinations, confabulations, or fabricated information (see Section 8.6).
YOU ACKNOWLEDGE THAT NUTRITION AND DIETARY DECISIONS INVOLVE INHERENT HEALTH RISKS, THAT AI TECHNOLOGY IS INHERENTLY SUBJECT TO ERRORS INCLUDING HALLUCINATION AND CONFABULATION, AND THAT AI-GENERATED RECOMMENDATIONS ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE. YOU ASSUME ALL RISKS ASSOCIATED WITH ACTING ON AI-GENERATED DIETARY INFORMATION (SEE SECTION 8.8).

13. Limitation of Liability
13.1 Exclusion of Health-Related Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUTRIFY ME AI (INCLUDING KASH INDIA, ITS PROPRIETOR, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS) SHALL NOT BE LIABLE FOR ANY ADVERSE HEALTH OUTCOME, INJURY, ILLNESS, ALLERGIC REACTION, MEDICAL COMPLICATION, WORSENING OF A MEDICAL CONDITION, OR DEATH ARISING FROM OR RELATED TO:
  • Your reliance on AI-generated meal plans, dietary suggestions, nutritional estimates, or conversational responses.
  • The AI's failure to identify allergens, food-drug interactions, or unsuitable foods for your medical condition.
  • Inaccurate extraction of lab values from uploaded reports.
  • Your decision to follow dietary recommendations without consulting a healthcare provider.
  • Triggering or exacerbation of an eating disorder or disordered eating behaviors.
  • Any health decision made based on information provided by the Service.
  • AI hallucinations, confabulations, or fabricated outputs (see Section 8.6), including fabricated nutritional values, false medical claims, or invented food-drug interaction warnings.
13.2 Exclusion of Indirect Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUTRIFY ME AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
  • Loss of health, wellbeing, or quality of life.
  • Medical expenses, hospitalization costs, or treatment costs arising from reliance on the Service.
  • Loss of data, including health profile data, meal logs, or AI chat history.
  • Emotional distress, anxiety, or psychological harm related to diet tracking or nutritional information.
  • Loss of profits, revenue, or business opportunities.
  • Cost of procuring substitute services.
  • Damages resulting from AI inaccuracies, errors, or omissions.
  • Damages resulting from actions taken by third-party AI providers.
  • Any claims brought against you by third parties as a result of your use of the Service.

This exclusion applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if Nutrify Me AI has been advised of the possibility of such damages.

13.3 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUTRIFY ME AI'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO NUTRIFY ME AI IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ₹5,000 (FIVE THOUSAND INDIAN RUPEES).
13.4 Essential Basis of the Agreement

You acknowledge that the limitations of liability in this section reflect a fair and reasonable allocation of risk between you and Nutrify Me AI, that the Service would not be available to you at the current pricing (including the free tier) without these limitations, and that these limitations apply even if any limited remedy fails of its essential purpose. You specifically acknowledge that the Service provides AI-generated wellness information only and is not a healthcare service, and that this fundamental nature of the Service is a key basis for these liability limitations.


14. Indemnification

You agree to indemnify, defend, and hold harmless Nutrify Me AI (including Kash India, its proprietor, employees, agents, contractors, and service providers) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and costs of investigation) arising out of or in connection with:

  • Your use of the Service, including any health decisions you make based on AI-generated information.
  • Any adverse health outcome, allergic reaction, medical complication, or injury arising from your reliance on the Service's outputs.
  • Health data you input into the Service, including claims arising from inaccurate self-reported data.
  • Your violation of these Terms, any applicable law, or any third party's rights.
  • Your failure to consult a healthcare provider before acting on the Service's dietary suggestions, particularly when you have known medical conditions, allergies, or are taking medications.
  • Claims by third parties arising from your sharing or dissemination of AI-generated content from the Service.
  • Your breach of any representation or warranty made in these Terms.
  • Your use of the Service despite having a condition for which such use is contraindicated (such as an active eating disorder).
  • Any regulatory investigation, government inquiry, compliance audit, or enforcement action initiated against Nutrify Me AI or Kash India as a result of your use of the Service, your data, or your conduct.
  • Claims that your use of the Service or the data you provide infringes the intellectual property, privacy, or other rights of any third party.

This indemnification obligation survives the termination of your account and these Terms. You will cooperate fully with Nutrify Me AI in the defense of any claim. Nutrify Me AI reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree not to settle any such matter without our prior written consent.


15. Termination
15.1 Termination by You

You may cancel your subscription and terminate your account at any time through the app settings, account management, or by contacting us at help@nutrifyme.ai.

  • If you cancel a paid subscription, you will retain access until the end of your current billing period.
  • Upon account termination, all health data (medical conditions, medications, lab values, allergies, family history) will be deleted within 15 days.
  • All other data (meal logs, AI chat history, account information) will be deleted within 30 days.
  • Anonymized, aggregated data that cannot identify you or reconstruct your health information may be retained indefinitely.
15.2 Termination by Nutrify Me AI

We may suspend or terminate your account, with or without notice, at our sole discretion, if:

  • You breach these Terms, including the Acceptable Use Policy (Section 6).
  • We reasonably believe you are using the Service in a manner that could be harmful to your health or the health of others.
  • We are required to do so by law, regulation, or a court order.
  • A third-party platform (Apple, Google, OpenAI, Anthropic, or any other) requests that we terminate your access.
  • Your account has been inactive for more than 12 consecutive months.
  • We determine, in our sole judgment, that your continued use poses a risk to the Service, our infrastructure, or other users.

In the event of termination for breach or policy violation, we are not obligated to provide any refund, credit, prior notice, or opportunity to cure.

15.3 Effect of Termination

Upon termination (whether by you or by us):

  • Your license to use the Service immediately ends.
  • All health data, meal logs, AI chat history, and account data will be deleted as described above.
  • You remain liable for any activities conducted through your account prior to termination.
15.4 Survival

The following sections survive termination of these Terms: the Health Disclaimers at the top of this document, Section 4.5 (Refund Policy and Statutory Rights), Section 4.8 (Chargebacks and Payment Disputes), Section 5 (User Responsibilities, including Section 5.2A), Section 7 (User Content and Health Data, including license grants), Section 8 (AI-Powered Features — Disclaimers, including Section 8.6 AI Hallucination Risk and Section 8.8 Assumption of Risk), Section 11 (Intellectual Property), Section 13 (Disclaimer of Warranties), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 17 (Governing Law and Dispute Resolution, including Section 17.6 Limitation Period), Section 18 (Force Majeure), Section 20 (Confidentiality), Section 21 (Compliance with Indian Law), and this Section 16.4.


16. Governing Law and Dispute Resolution
16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

16.2 Jurisdiction

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India. You irrevocably consent to the jurisdiction of these courts and waive any objection based on inconvenient forum.

16.3 Informal Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at help@nutrifyme.ai. We will attempt to resolve the dispute within 30 days.

16.4 Arbitration

For disputes that cannot be resolved informally, either party may elect to submit the dispute to binding arbitration in Ahmedabad, Gujarat, administered in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by both parties. The language of arbitration shall be English. The arbitrator's award shall be final and binding on both parties.

16.5 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16.6 Limitation Period for Claims

To the maximum extent permitted by applicable law, any claim or cause of action arising out of or relating to these Terms or the Service must be filed within one (1) year after the cause of action accrues (i.e., from the date you knew or should have known of the facts giving rise to the claim), regardless of any longer limitation period provided by law. Claims filed after this period are permanently barred. This limitation period applies to all claims, whether based in contract, tort, statute, or any other legal theory.


17. Force Majeure

Nutrify Me AI shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, acts of government, war, terrorism, civil unrest, power outages, internet or telecommunications failures, third-party platform outages or API changes (including OpenAI, Google, Anthropic, Apple, Google Play, Firebase, and AWS), third-party service provider failures, cyberattacks or security incidents at third-party providers, changes in applicable law or regulation, and acts of God.


18. Modifications to the Service and These Terms
18.1 Service Modifications

We reserve the right to modify, update, enhance, suspend, or discontinue any part of the Service at any time, at our sole discretion, with or without notice. This includes adding or removing features, changing AI providers, adjusting usage limits, modifying the recommendation engine, or discontinuing the Service entirely.

If we discontinue the Service entirely, we will provide at least 30 days' advance notice and, for active paid subscribers, a pro-rated refund for any pre-paid period remaining after the discontinuation date. This is the sole circumstance in which a refund will be issued.

18.2 Terms Modifications

We may update these Terms from time to time. When we make material changes:

  • We will update the “Last Updated” date at the top of this document.
  • We will notify you via email or a prominent in-app notification at least 15 days before the new Terms take effect.
  • Your continued use of the Service after the new effective date constitutes your acceptance of the modified Terms.

For non-material changes (such as corrections, clarifications, or formatting), we may update these Terms without prior notice.

18.3 Regulatory Changes

If any change in applicable law, regulation, or regulatory guidance (including health regulations, data protection laws, AI regulations, or app store policies) requires us to modify, restrict, or discontinue any feature of the Service, we may do so immediately and without prior notice. Such regulatory-driven changes are not considered a breach of these Terms and do not entitle you to a refund, credit, or claim.


19. Confidentiality
19.1 Your Confidential Information

We treat your health data, personal information, meal logs, and AI chat history as confidential and will not disclose them except as described in our Privacy Policy and these Terms.

19.2 Our Confidential Information

The Service contains proprietary technology, algorithms, AI integrations, recommendation logic, business processes, and trade secrets that constitute our confidential information. You agree not to disclose, reverse-engineer, or misappropriate any of our confidential information.

19.3 Exceptions

Confidentiality obligations do not apply to information that: (a) is or becomes publicly available through no fault of the receiving party, (b) was already known to the receiving party, (c) is independently developed by the receiving party, or (d) must be disclosed by law.


20. Compliance with Indian Law
20.1 Consumer Protection Act, 2019

We comply with the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020, as applicable. In accordance with these rules:

  • Our legal name, registered address, and customer care contact details are published in Section 24 and on our website.
  • Our refund, cancellation, and subscription renewal policies are clearly disclosed in Section 4.
  • We do not engage in unfair trade practices as defined under the Act.
  • We provide a grievance redressal mechanism (see Section 21.2 below).

Nothing in these Terms excludes or limits your statutory rights as a consumer under applicable Indian law.

20.2 Grievance Redressal

In accordance with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer:

If you have any complaints or grievances relating to the Service, the Grievance Officer will acknowledge your complaint within 48 hours and endeavor to resolve it within 30 days. Grievances related to health data will be prioritized. If you are not satisfied with the resolution, you may escalate the matter through the consumer dispute redressal mechanisms available under the Consumer Protection Act, 2019.

20.3 Information Technology Act, 2000

To the extent applicable, Nutrify Me AI complies with the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

20.4 Not a Medical Device

Nutrify Me AI is classified as a general wellness application and is not regulated as a medical device under the Medical Devices Rules, 2017 (India), the Central Drugs Standard Control Organisation (CDSCO) guidelines, or equivalent regulations in other jurisdictions. The Service does not meet the definition of a medical device because it does not diagnose, treat, cure, mitigate, or prevent any disease or medical condition. It provides general wellness and nutritional information only.


21. Beta Features and Early Access
21.1 Beta Features

From time to time, we may offer beta features, early access programs, or preview releases (“Beta Features”). Beta Features are provided “as is” and “as available” without any warranty or availability commitment. Given the health-sensitive nature of the Service, Beta Features may carry additional risks of inaccuracy. Exercise extra caution when using Beta Features for any health-related decisions.

21.2 Beta Disclaimers

By using any Beta Feature, you acknowledge that: (a) Beta Features may not work as expected and may cause data loss or service disruptions, (b) we may modify or discontinue Beta Features at any time without notice or liability, (c) Beta Features may produce less accurate nutritional estimates or meal plans than generally available features, and (d) feedback you provide about Beta Features is subject to the Feedback license in Section 11.3.


22. General Provisions
22.1 Entire Agreement

These Terms, together with the Privacy Policy and any plan-specific terms presented through the Service, constitute the entire agreement between you and Nutrify Me AI regarding the Service. They supersede all prior agreements, understandings, or communications regarding the subject matter.

22.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable (or severed if modification is not possible), and the remaining provisions shall continue in full force and effect.

22.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any term is only effective if it is in writing and signed by Nutrify Me AI.

22.4 Assignment

You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. Nutrify Me AI may freely assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or to any affiliate or successor entity, without your consent and without notice.

22.5 Notices

All notices from Nutrify Me AI to you will be sent to the email address associated with your account or via in-app notification. Notices are deemed received when sent. All notices from you to Nutrify Me AI should be sent to help@nutrifyme.ai.

22.6 No Third-Party Beneficiaries

These Terms do not confer any rights or remedies on any third party, except as expressly stated herein (including Apple and Google as third-party beneficiaries with respect to the mobile app per Section 9.1).

22.7 No Partnership or Agency

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and Nutrify Me AI. You have no authority to bind Nutrify Me AI in any way.

22.8 No Healthcare Relationship

Your use of the Service does not create a healthcare provider-patient relationship, a dietitian-client relationship, or any other professional health advisory relationship between you and Nutrify Me AI, Kash India, or any of our employees, contractors, or agents. We are a technology company providing an AI-powered wellness tool, not a healthcare provider.

22.9 Language

These Terms are written in English. If these Terms are translated into any other language for convenience, the English version shall prevail in the event of any conflict or discrepancy.

22.10 Headings

The headings in these Terms are for convenience only and do not affect the interpretation of any provision.

22.11 Electronic Communications Consent

By creating an account and using the Service, you consent to receive communications from us electronically (via email, in-app notifications, and push notifications). You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. This consent applies to all notices under these Terms, including notices of changes to these Terms, privacy policy updates, billing notifications, and any other Service-related communications.

22.12 Cumulative Remedies

All rights and remedies available to Nutrify Me AI under these Terms are cumulative and in addition to every other right or remedy available at law, in equity, or under these Terms. The exercise of any right or remedy shall not limit or waive any other right or remedy.

22.13 Interpretation

In these Terms: (a) "including" means "including without limitation"; (b) references to "days" mean calendar days unless otherwise specified; (c) references to currency mean Indian Rupees (₹/INR) unless otherwise specified; (d) the word "or" is not exclusive; and (e) references to any law, regulation, or rule include all amendments and successor provisions.
